Move Advanced Plus
If a US American married a Canadian in Canada, but then they moved to the USA, how do you go about it?
She is Canadian. She likes a church in Canada to marry in, plus her parents live up there. But then the plan would be to move to the US. As the American, what kind of paperwork do I need to consider? Thanks in advance.
My wife and I went through all of this last year. There is no problems with getting married in Canada at all. Just sign your marriage certificate and its all done.
You have a few options on how you want to bring your wife to the US.
The way that I recommend to get it all done the fastest is to have your wife file all of her immigration paperwork when she comes down to visit you in the US after your wedding. This is the way that my wife and I did it and she got her permanent residency (aka Green Card) in just under six months.
The paperwork that you will need to fill out can all be found at the USCIS website which is www.uscis.gov. Just do a Google search for each of the forms that I list and you'll be able to find them easier.
The forms that you will need to submit when you guys file from within the US are:
I-130 (Petition For Alien Relative)
G-325A (Biographical Information) - One form for each of you.
I-485 (Application to Register Permanent Resident or Adjust Status)
I-693 (Medical Examination of Aliens Seeking Adjustment of Status) - You'll need to find a Doctor near your US home that is approved by the USCIS to perform a physical on your wife.
I-864 (Affidavit of Support) - This tells the government that you can financially support your wife.
I-765 (Application for Employment Authorization) - This one is optional. You will need to file it if your wife wants to work until she gets her Green Card.
This are all the forms that I can think of off the top of my head. There are additional items that you will need to provide that are explained in the instructions for each one. The overall costs that my wife and I spent for her to come down here including fees, medical exam, etc was about $1100. That was a year ago and I don't know if it went up any or not.
Other options to bring her to the US include filing for a K-3 Visa and the I-130 while she is still in Canada. I've heard that she could be waiting anywhere from 6 months to a year before she is approved to come to the states though. Filing the I-130 while she is in Canada will still require you to file the I-485 and everything else afterwards, so it will just delay getting the Green Card even further.
